1. Acceptance of Terms

By accessing or using the Svarasattva website at svarasattva.com and the Svarasattva mobile application (collectively, the "Service"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, you must not use the Service.

These Terms constitute a legally binding agreement between you and Svarasattva ("we," "us," or "our"). We may update these Terms from time to time, and your continued use of the Service after such changes constitutes acceptance of the updated Terms.

2. Eligibility

You must be at least 13 years of age to use our Service. Users between 13 and 18 years of age must have the consent of a parent or legal guardian, who agrees to be bound by these Terms on their behalf. By using the Service, you represent and warrant that you meet these eligibility requirements.

3. Account Registration and Security

To access certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration and keep it updated.
• Maintain the confidentiality of your password and account credentials.
• Notify us immediately of any unauthorized access to or use of your account.
• Accept responsibility for all activities that occur under your account.

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.

4. Educational Services

Svarasattva provides an online educational platform for Indian classical music, yoga, and holistic wellness. Our services include:

• Live online classes conducted by qualified instructors in group and individual formats.
• Pre-recorded video lessons and educational content accessible through the platform.
• Class scheduling, attendance tracking, and learning progress management.
• Push notifications for class reminders, schedule changes, and important updates.

We reserve the right to modify, suspend, or discontinue any part of our services at any time with reasonable notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

5. Class Policies

As a student enrolled in our courses, you agree to:

• Attend scheduled classes on time. Repeated no-shows without prior notice may result in forfeiture of the class without refund.
• Provide at least 24 hours' notice for class cancellations or rescheduling requests. Cancellations made with less than 24 hours' notice may not be eligible for rescheduling.
• Maintain a respectful and conducive learning environment during all classes. We maintain a zero-tolerance policy for harassment, discrimination, or disruptive behavior.
• Ensure you have a stable internet connection and appropriate equipment (camera, microphone) for live classes.

Instructors reserve the right to remove disruptive participants from a class session. Repeated violations may result in termination of your enrollment without refund.

6. Payment, Billing, and Subscriptions

Access to our courses requires a paid subscription or one-time course purchase. By making a payment, you agree to the following:

• All prices are listed in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise.
• Payments are processed securely through our third-party payment processor, Easebuzz. We do not store your payment card details on our servers.
• Subscriptions are billed in advance for the selected billing period (monthly or quarterly). Your subscription remains active until the end of the paid period.
• We reserve the right to change our pricing with at least 30 days' notice. Price changes will not affect your current billing period.
• Failed payments may result in suspension of access to course content until payment is resolved.

7. Refund Policy

We want you to be satisfied with our services. Our refund policy is as follows:

• Within 7 days of purchase: If you have not attended any classes, you may request a full refund.
• After attending classes: Refunds are calculated on a pro-rata basis for the unused portion of your subscription, minus any classes already attended.
• No refund: Refunds are not available after the subscription period has ended, or for classes missed without prior notice.
• Processing time: Approved refunds will be processed within 7–10 business days to the original payment method.

8. Intellectual Property

All content on the Service, including but not limited to text, graphics, logos, images, audio clips, video recordings, course materials, curriculum designs, and software, is the property of Svarasattva or its content providers and is protected by Indian and international copyright, trademark, and intellectual property laws.

• Course materials, video lessons, and educational content are licensed to you for personal, non-commercial use only during your active enrollment.
• You may not copy, reproduce, distribute, transmit, broadcast, display, sell, license, or otherwise exploit any content from the Service without our prior written consent.
• Screen recording, downloading, or capturing of live classes or video content is strictly prohibited.
• The Svarasattva name, logo, and all related names, logos, product and service names, designs, and slogans are our trademarks. You may not use them without our prior written permission.

9. User Conduct

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
• Share your account credentials with others or allow multiple people to use a single account.
• Attempt to gain unauthorized access to any part of the Service, other accounts, or computer systems.
• Interfere with or disrupt the Service or servers or networks connected to the Service.
• Upload or transmit viruses, malware, or any other malicious code.
• Harass, abuse, or harm other users, instructors, or staff members.
• Use automated scripts, bots, or scrapers to access the Service.

10. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices regarding your personal data.

11. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not guarantee any specific learning outcomes or results from using our educational services.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Svarasattva and its directors, employees, partners, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your use of the Service.

Our total liability for any claims arising under these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless Svarasattva and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of another party.

14. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination:

• Your right to use the Service will immediately cease.
• We may delete your account data after a reasonable retention period, subject to our Privacy Policy and legal obligations.
• Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

You may terminate your account at any time by contacting us at contact@svarasattva.com. Termination does not entitle you to a refund for any unused portion of a prepaid subscription unless covered by our Refund Policy.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved within 30 days, it shall be subject to the exclusive jurisdiction of the courts located in Ernakulam, Kerala, India.

16. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.

17. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published on the Service, constitute the entire agreement between you and Svarasattva regarding your use of the Service and supersede all prior agreements and understandings.
